Introduction

In this essay I will allow myself to develop an issue in which I have put interest, seeing how this group of people are discriminated against, I mean people with disabilities, in this case I want to describe; who are they?, What are your rights?, What guarantees the State?, What are your duties?, and show a percentage of group of people who are violated, seen that we currently live a very daily reality where people with disabilities, although a minority group, in which much of their moments have been excluded, that is why I will focus on knowing much more on this subject.

Developing

We live in a world of many conflicts where the person who has the necessary resources survive, while the people who do not have these resources tend to be discriminated or granted inferior treatment in society. Given this I want to leave a concept of what is discrimination?

According to the United Nations Convention of Human Rights, discrimination is known for giving improper treatment to people who deserve to be in the same way that although we are all equal that we have the advantage of enjoying the pampering rights and duties that seek meet the needs of people since many rights are restricted (National Human Rights Commission, 2012, p. 6)

Stating that anyone can be discrimination, however, these are under the situation of disadvantage or vulnerability due to their condition.

And as a second point I want to publicize the concept of person with disabilities that according to the Regulation to the Organic Disabilities Law (2017) ARTICLE 1.

– Of people with disabilities. – It is defined that they will be recognized as people with disabilities, the people who have the effect of one or more physical, mental, intellectual or sensory insufficiencies who will be seen with an inability to be able to develop in their entirety. And in which its biological or psychological capacity is affected, which does not allow it to have a full life or to be able to develop in its daily life, taking into account that disability is competent in 30% disability. (Regulation to the Organic Law of Disabilities, 2017, p. 3)

To synthesize we can end up saying that the disabled is a condition under which a person presents or has physical, mental, intellectual or sensory deficiency of a permanent nature since when interacting with various attitudinal barriers and the environment, so that it does not allow them to develop in the house, school, work, society making it cannot exercise or can be prevented from the exercise of their rights.

The United Nations Convention (2014) states that: on December 13, 2006, he was able to know the rights with people with disabilities in the Convention and taking into account that on May 3, 2008 he enters into mood. This entire agreement was creating with the sole purpose of the rights of persons with disabilities must also be respected and protected by giving effective results of respect and equality.(United Nations, 2014, p. 4)

While there are laws, regulations, rules of people with disabilities, but nevertheless they have only stayed in written papers, since many of the authorities are made of a blind eye at the time of asking that said right and even many of The occasions are only heard.

But the Ecuadorian State and according to the Constitution of the Republic of Ecuador as a guarantee of rights points in article 47.- That the Ecuadorian State as the highest authority will be the one who through the authorities provides public policies that are aimed at society, family and even more policies that have benefit for people with disabilities in which they are included in society. (Ecuador, 2008, p. 36)

Allowing people with disabilities not to be excluded but rather included in society and that they are treated as the rest of the population and even having both civil and political rights.

As we know the human rights are universal where any person without any distinction is excluded. That is why even people with disabilities are attached to rights. I will allow to mention and make known among one of the rights that a person with disabilities has; The right to be excluded by its condition, having a joy of rights and freedoms, including the right to have the same opportunities in all social spheres including politicians to be able to exercise a public position since every person is layers if they are provided ; that is also given and that equality is fulfilled; that can and are given the necessary health services to achieve a full life. (Oswaldo & Miño, 2006)

Adding to this article 133 and article 11 numeral 2 of the Constitution for the creation or basis of the existing regulation to the Organic Law of Disabilities that was built or established in order for this priority care group to also be respected and guaranteed their rights since on many occasions they have not been given the attention they require.

However, in some and in many of the occasions there has been no correct application of the rights and duties, since there are several deficiencies in which the person with disabilities does not allow to develop in the dignified way as the Constitution typifies it. To do this I tend to develop clear examples in which some rights of these people are violated.

Next, I will allow myself to tell a case in which López Byron one between 361. 438 of people with disabilities that exists in our Ecuadorian country was found in an amount where he felt discriminated against by his capacity since he does not have a leg and that has forced him to have to walk in a wheelchair. In our country there is a disadvantage for this group of people with disabilities, emphasizing that in Ecuador there are no transport that goes with the appropriate necessary facilities in which it allows them to easily transport a person with disabilities. For this reason it is where the person is discriminated against by the State since there is no concern in front of this.

And in the case of Byron who suffers from physical disability. And at the same time he is a victim of discrimination since he was not given the discount that belongs to him, taken into account that it is a right that is typified in the law and there are even cases where despite indicating their disability card, people Only their rights being violated and discriminating against them being violated and discriminating against them. Another realities that a person with disabilities must live is that when he goes out with the aim of taking a taxi or a bus, there are people who do not stop him for the simple fact that he has to do an extra job for them.

In addition, adding to this, the great difficulty that they have to suffer due to transport: seen that in our country people who have disabled cannot easily access a public transport since in the same way the transport does not have the necessary comforts for A person with discrimination, in much of the cities of Ecuador there is no bus or transport in which they can be easily transported or without receiving any kind of spoiled from other people. Forcing people with disabilities to be locked at home.

The State as a guarantee of rights, should invest in a transportation for this minority of people in which they can be easily transported, in which there is no spoils or in which it has the assurance that no risk of risk will have then there will be reflected from the right to public transportation. Because of this we would prevent many of the people with low resource disabilities or even people who cannot reach their destination, because they do not have to pay a taxi or because they have to get to the stop of a bus and wait for one of People pity and can help you. All this would be avoided if we start thinking for an amount in them or we put ourselves in their role and look how difficult they find themselves to reach their destiny.

As mentioned above, people with disabilities are a minority group that in many cases are discriminated against society, because there is no concern of them and even giving them importance in society. I mean that many of these people must get ahead on their own.

Taking into account that many of these people cannot have a job due to their conditions, because in society they look at them as people who do not have the same capacity as others, this is the mentality that today’s people are due and Let’s change since all people must be treated with the same respect and with equality there are no discrimination.

The State has been obliged that the Labor Ministries carry out inspections in several of the companies to comply with the Organic Disabilities Law (2012) as typified in article 47 Labor Inclusion. – In which it tells us that a company is either public or private and is seen in the obligation to hire in a minimum percentage to people with disabilities so that they are included in the social sphere allowing them not to be excluded. Being that people who get to work in said company will have a job or carry out an activity in which their disability is taken into consideration in which their skills are rescued and the principles of equity and even of gender.(Organic Dediscapacities Law, 2012, p. 13)

The Ministry of Labor together with the Secretary of Labor undertakes to carry out inspections in surprise both public and private companies in order to respect the right to work and in which this group of people are included. But in many cases the heads of companies prefer to be sanctioned with a fine to hire a person with disabilities. And this makes people with disabilities be violated since they cannot have a job to respond with their needs.

There are also discrimination or a violation of the right to work since in many occasions people with disabilities are rejected to be able to work in a company or an entity, because society or people live with the mentality that they are disabilities of power of power do a job, an idea that is in the whole error of the word since every person can be and is able to perform an activity if it is proposed. In many cases there are people who despite the disability they have much better than a person who has no disability, which is why before judging or rejecting a person we first have to see or know their talent.

I also want to emphasize that the violation of day by day grows since you remain almost invisible in society with taking them into account in many cases, since for them there are barriers that do not allow them to have a decent and full development either In the environment, which is why they are not accepted within it, in communication because it does not have the ease as the rest of people have, in the information because even in our country there are not adequate signaling for this group of people and Even attitudes and prejudices bringing this consequences the limitations of people with disabilities to the fundamental aspects of life as well as education, health, work and most important of a life free of violence.

Although in our society the right to education is a primary and fundamental mechanism of the person since thanks to this it will allow you to have a better suitability of life, but it is reflected that there are few people with disabilities who access these educational spaces, Reasons in which it looks like the level of discrimination is today. Many of the people with disabilities who want to access education have had to study a private institution since it is where there is still a better treatment, but everything in exchange for money. While people who do not have the necessary resources to lose registration of a private school are to end in some of the cases their dreams of being able to get ahead.(Rodolfo Cruz, 2016)

Based on the above I want to focus on the discrimination that is also given in the educational field, since many of these people cannot access a public institution with ease although in the institutions there are not adequate facilities for a person with disabilities It can be developed. Referring to a clear example; in which a person who has physical disability when he goes to an educational institution cannot easily access his classroom by the always made that he does not have the ramps would need or even existing any being one of the first obstacles that he has The person, in which this kind of problem should be the Ecuadorian State who must force any public or private institution to place or perform the necessary ramps so that anyone can and it is easy to reach their study classroom.

In another case, children, girls, young people who access education cannot be done in their entirety, that is, their teachers or teachers do not have enough preparation to be able to teach this group of people, because of This many of the young people give out and not continue with their studies, for this and many more reasons that occur in the present, the State as a guarantee and protector of the pampering must make a change so that the right to Education and much more the person can live in society with pleasure.

It is also an amount to emphasize that people as they are; Young people or children with sensory disabilities tend to have communication difficulties in educational centers since their teachers are not in the ability to give a class for them, in this case who must access to have a better preparation is the teacher so that Give compliance with the right to communication accessibility allowing them to use a format or medium of communication such as sign language, braille system or any format or medium of communication that the child or young man needs in order to also receive an academic class. Or either in different cases the teacher must prepare a class in which it allows you to provide learning.

Because of everything mentioned above, it is important and accurate that another contemplation is made in the face of people with disabilities in which the typified rights are fulfilled not only for the end of an obligation but also with the purpose that this whole group of people are treated as rights subjects in which they are included in society. Allowing these people that all the dreams they have to fulfill are not only a longing but also become a reality. How to study, work or have decent security. Since for simple fact of being a human being, he gives him the guarantee of living dignity. (Rodolfo Cruz, 2016)

The person with disabilities should not be seen as a burden or as a person who must be sorry for their physical, mental, intellectual or sensory condition since they must be included as normal people who are.

These and many more are the negative consequences that a person with disabilities must live that is why the State against this violation of law must react so that all Ecuadorians can have and the decent life is guaranteed that every person deserves. Ending discrimination, exclusion or isolation of people with disabilities.

People with disabilities should be a better quality of life in which each of us must change the way of thinking in front of them in this case to fight discrimination, where society must sensitize where more people look and We are worried about this reality that arises. If we make a change, this group of people could always live as it deserves in society.

Discrimination due to disability is a phenomenon that occurs in our society in which many of the people experience this reality. Although there are laws, norms or regulations for the recognition of rights and equality that must guarantee as a state this has not been enough to end discrimination since there are still many of the cases in which people with disabilities have obstacles that do not They allow to reach a full and participatory life in which it can be developed throughout its scope.

Although as I have mentioned in this essay some of the obstacles and barriers that a person with disabilities has is access to education, to have a job with which he can support him; or even in some cases your family. If all these negatives would be eliminated, this person could have full personal development and even integrate into society and would participate in it.

All the aforementioned in the painful reality that in many occasions the person looks humiliated in which he prevents him from continuing his life. In which a change of mentality of people is expected to take place in order to make equality and confirm even justice in favor of non -discrimination so that people with disabilities and are not victims of this scenario.

We have to take into account, it is important to act not only to combat the norms or regulations in order to be complied with but also in order to change each of the mentalities where we are all equal to the law because no one is superior to another either because it has better economic conditions or has a better life status, we are all equal and all must be and must be treated in the same way without any distinction.

Conclusions:

The only desire that a person with disabilities has is to be able to enjoy all his human rights in equal conditions in which he allows him to have a dignified life. Since it is prevented in the exercise of her rights on equal terms to others.

The only thing people with disabilities deserve or what they claim is a respectful treatment a treatment of equality in which they do not look at them as strange people and even more so that all their rights are respected.

It is worth mentioning that all they ask is to be the necessary support to achieve the autonomy of their own life to be able to take care of and even take care of their children. So that there is no discrimination violence.

In society, awareness must be created in recognition and understanding that this priority group has rights. Taking into account that people with disabilities are subjects of rights and it is the State who has to train teachers so that people with disabilities can access education without any complication.

However, it is important to emphasize that the State must install and support that both public transport and educational institutions have the necessary facilities so that this group of people can access them guaranteeing the right to security.

That is why I consider that the eradication or decrease of the present discrimination against disabled people is important by changing our way of thinking and treating them with the respect and equality that they deserve.
