End of Money Bail
The purpose of cash bail is to make sure that the defendant will appear for pre-trial and trial hearings that they are required to present. Cash bail is a way of releasing lower-risk persons back into the society before the actual trial to assist in offsetting the family and the public all the burdens that are linked with jail admission (Harrison 533). However, this can create some loophole in the system and can lead to failure in court in the future. Cash bail has an aspect of protecting the liberty of an individual since the court will only charge the suspect if they failed to return to court (Smith 451). Besides, in cases where demand is not justified, the suspect is not subjected to it forcefully, and as a result, the cash bail helps the individual to continue with their lives as usual as they await trial. The 8th Amendment of the US states that bail is a constitutional right and indicates that excessive bail is not needed. Besides, excessive is solely left at the discretion of the judiciary.
The challenge with the United States bail system is that their economic status influences the chances of a suspect been released in the United States. In states such as Alaska and New Jersey, have completely abolished cash bail while California will also abolish it in 2019. The state intends to abolish cash bail and allow the judges to decide on who goes home and who stays for pending trial (Harrison 533). However, some people fear that these reforms will spring some new problems whereby, there will be an increase in pre-trial incarceration since the decision will be at the discretion of the judge.
