In this situation, the officer in question has to some extent given untruthful information to the grand jury. In my case, I would talk to my supervisor about the issue since it seems there may be some ramification of the situation. Above all, the officer’s integrity will be questionable and thus his duty or career as an officer. In the case of the grand jury, they need to hear the case again. Besides, the officer who witnessed the incident is supposed to appear before the board to explain what transpired on the scene and the case reassessed again.
Question two
I would first ask myself a question “how did the old woman die?” After confirming that there is no suspicion of the death, I would continue with the case. This is because the death of the witness does not in any way change the facts of the case; instead, it only strengthens the case because there is no witness. Consequently, the death of the woman does not imply the defendant’s guilt.
Question three.
The first thing I would ask is what the term erratic means in the context it was used (Andrews, 2014). Furthermore, I would want to know what the defendant did after being flagged to stop, did he or did he not stop? Moreover, I would like to know the questions and answers provided by the officer in question, for instance, was the defendant alone? What reason did the defendant give for lacking the registration plate and the driving license? Also, did the officer run the car details to confirm that the car belongs to the defendant or if it had been registered as stolen? Furthermore, I would need to know the condition in which the drugs were found and whether the defendant made any statement regarding them.
